Many couples, however, are unsure whether they should apply onshore or offshore, and what evidence is required.

Onshore Partner Visa (Subclass 820/801)

If you are already in Australia, you can apply for the onshore Partner visa. You’ll be granted a temporary visa (Subclass 820) while waiting for assessment of your permanent visa (Subclass 801). This allows you to remain in Australia, access Medicare, and often apply for work rights while the application is processed.

Offshore Partner Visa (Subclass 309/100)

If you are outside Australia, you can apply for the offshore Partner visa. You’ll first be granted a temporary visa (Subclass 309), and once eligible, progress to the permanent visa (Subclass 100). This pathway allows couples to start their application while living abroad, with the flexibility to travel to Australia after the temporary visa grant.

Key Partner Visa Requirements

To succeed in your application, you will need to show:

  • A genuine and continuing relationship with your partner
  • Marriage or a de facto relationship (usually at least 12 months unless exempt)
  • Evidence of financial commitment, social recognition, and shared household
  • Health and character clearances
  • A sponsor who is an Australian citizen, permanent resident, or eligible New Zealand citizen

Prospective Marriage Visa (Subclass 300)

For couples who are engaged but not yet married, the Prospective Marriage visa offers a pathway to join your partner in Australia. This visa is lodged offshore and allows you to enter Australia, marry your sponsor within 9–15 months, and then apply for the onshore Partner visa (Subclass 820/801).

Key Features:

  • Must be outside Australia when applying and when the visa is granted
  • Evidence of a genuine intention to marry within the visa period
  • Same sponsor eligibility as Partner visas (Australian citizen, permanent resident, or eligible NZ citizen)
  • Provides a pathway to permanent residency after marriage

This option is particularly helpful for couples not yet living together but committed to starting their life together in Australia.
